I earned my bachelor’s degree in Chemistry from Santa Clara University. I continued my education at Santa Clara University and earned my Juris Doctorate. I opened my practice in October 1990 and have represented thousands of debtors in bankruptcy matters. I meet and advise clients during the initial consultation and personally prepare and represent my clients in Chapter 7, Chapter 11, and complex Chapter 13 bankruptcy cases.

Bankruptcy Law Services I Offer
Both individuals and businesses can file for Chapter 7 bankruptcy. In a Chapter 7 bankruptcy, you disclose all your assets and in the case of an individual Debtor, exempt those assets for which the law provides an exemption. Most Debtors retain all their assets. However, if there are non-exempt assets, unless those assets are too burdensome to the estate or of insubstantial value, the Chapter 7 Trustee may sell those assets and disburse the net proceeds, after Trustee fees and Trustee attorney fees, to creditors.

A Chapter 11 is a reorganization for companies or for individuals where the amount of their debts exceeds the statutory limits under Chapter 13. In Chapter 11, you propose a plan of reorganization where secured creditors are paid back the value of their collateral, priority creditors (such as taxes) are repaid over time and a dividend is paid to general unsecured creditors generally paid over time. Only individuals are eligible to reorganize under Chapter 13. A Chapter 13 is a powerful tool to stay the foreclosure sale of real property, prevent repossession of personal property, stay pending litigation and keep the taxing authorities at bay. In Chapter 13, you propose a plan of reorganization which cures mortgage arrears over as much as five years, repays those tax obligations which cannot be discharged over 5 years and repays general unsecured creditors a dividend (often 0%) which meets at a minimum the liquidation test (what general unsecured creditors would receive in a hypothetical Chapter 7).
